1. Introduction and Acceptance

Welcome to Aerrand ("we," "us," "our," or "Aerrand"). These Terms and Conditions ("Terms") govern your access to and use of the Aerrand platform, including our website, mobile application, and related services (collectively, the "Platform").

By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Platform.

2. Description of Services

Aerrand is a peer-to-peer marketplace platform that connects users who need delivery services ("Senders") with independent service providers who provide delivery services ("Aerranders"). Aerrand provides the technology platform but does not itself provide delivery services.

2.1 Core Services

• Same-day package delivery coordination
• Real-time GPS tracking
• In-app communication between Senders and Aerranders
• Payment processing
• Optional escrow verification services

2.2 Optional Escrow Verification

Escrow verification is an optional service that allows Senders to:

• Communicate with Aerranders at the pickup location
• Request and receive photos of packages before pickup
• Approve or reject pickup based on package condition
• Escrow verification fees vary based on distance and wait time

3. Eligibility

You must be at least 10 years old to use the Platform. By using the Platform, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

3.1 Aerrander Requirements

To become an Aerrander, you must:

• Be at least 18 years old
• Pass a background check
• Maintain valid identification and any required licenses
• Have reliable transportation
• Maintain appropriate insurance coverage

4. User Accounts

4.1 Account Creation

You must create an account to use the Platform. You agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Notify us immediately of any unauthorized access

4.2 Account Responsibility

You are responsible for all activities that occur under your account. You may not share your account credentials or transfer your account to another person.

5. Prohibited Items

The following items may NOT be sent through the Aerrand platform:

• Illegal drugs or controlled substances
• Weapons, firearms, ammunition, or explosives
• Hazardous materials or chemicals
• Stolen goods or counterfeit items
• Alcohol or tobacco products (unless permitted by local law and with proper verification)
• Live animals
• Human remains or body parts
• Items that violate intellectual property rights
• Perishable foods requiring temperature control (unless properly packaged)
• Cash exceeding $500
• Items prohibited by federal, state, or local law

Senders are solely responsible for ensuring packages comply with all applicable laws and these Terms.

6. User Conduct

6.1 General Conduct

You agree not to:

• Violate any applicable laws or regulations
• Infringe on others' intellectual property rights
• Harass, threaten, or harm other users
• Use the Platform for fraudulent purposes
• Interfere with or disrupt the Platform
• Attempt to gain unauthorized access to the Platform
• Use automated systems to access the Platform without permission

6.2 Sender Responsibilities

Senders must:

• Accurately describe packages and their contents
• Properly package items to prevent damage during transit
• Be available for communication during pickup and delivery
• Ensure packages comply with all applicable laws
• Provide accurate pickup and delivery addresses

6.3 Aerrander Responsibilities

Aerranders must:

• Handle packages with reasonable care
• Follow delivery instructions provided by Senders
• Communicate professionally with Senders
• Complete deliveries in a timely manner
• Maintain appropriate vehicle insurance
• Comply with all traffic laws and regulations

7. Escrow Verification Service

7.1 How Escrow Works

When escrow verification is selected:

1. Aerrander arrives at the pickup location
2. Aerrander sends photos of the package to Sender
3. Sender and Aerrander communicate via in-app chat
4. Sender approves or rejects pickup based on package condition
5. Upon approval, Aerrander picks up and delivers the package

7.2 Escrow Fees

Escrow verification incurs additional fees based on:

• Distance to pickup location
• Wait time at pickup location
• Complexity of verification required

Fees are disclosed upfront and must be accepted before booking.

7.3 Escrow Limitations

• Aerrand is not responsible for Sender's assessment of package condition
• Photos provided are for informational purposes only
• Senders must make approval decisions promptly to avoid excessive wait time fees
• If Sender rejects pickup, standard cancellation fees may apply

8. Pricing and Payment

8.1 Fees

Delivery fees are calculated based on:

• Distance
• Delivery urgency
• Escrow verification (if selected)
• Demand at the time of booking

All fees are displayed before you confirm a booking.

8.2 Payment Authorization

By booking a delivery, you authorize Aerrand to charge your selected payment method for:

• Delivery fees
• Escrow verification fees (if applicable)
• Tips (optional)
• Any additional fees disclosed at booking

8.3 Aerrander Compensation

Aerranders are independent contractors and receive compensation based on the delivery fees, minus Aerrand's service fee and applicable transaction costs.

8.4 Refunds

Refunds may be issued at Aerrand's discretion in cases of:

• Service failure
• Aerrander misconduct
• Lost or damaged packages (subject to investigation)
• Cancelled deliveries (according to cancellation policy)

9. Cancellations

9.1 Sender Cancellations

• Cancellations before Aerrander acceptance: No fee
• Cancellations after acceptance but before pickup: Partial fee may apply
• Cancellations after pickup: Full fee applies (delivery must be completed or returned)

9.2 Aerrander Cancellations

Aerranders who cancel after accepting a delivery may face account penalties and reduced priority in future delivery assignments.

9.3 Aerrand Cancellations

Aerrand reserves the right to cancel any delivery that violates these Terms or applicable law.

10. Liability and Insurance

10.1 Platform Provider Status

Aerrand is a technology platform that connects Senders and Aerranders. Aerrand does not provide delivery services and is not responsible for the acts or omissions of Aerranders or Senders.

10.2 Limited Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AERRAND'S TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THE PLATFORM IS LIMITED TO THE AMOUNT YOU PAID TO AERRAND IN THE SIX (6) MONTHS PRECEDING THE CLAIM.

10.3 Package Loss or Damage

• Senders should properly package items to prevent damage
• Claims for lost or damaged packages must be reported within 24 hours of delivery or expected delivery time
• Aerrand will investigate claims and may provide compensation at its discretion, up to $100 per package unless additional insurance is purchased
• Aerrand is not liable for packages containing prohibited items

10.4 Aerrander Insurance

Aerranders are independent contractors responsible for maintaining their own insurance coverage, including vehicle insurance and liability insurance.

10.5 Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

11. Independent Contractor Relationship

Aerranders are independent contractors, not employees, agents, or partners of Aerrand. Aerranders:

• Control their own schedule and accept or reject delivery requests
• Are responsible for their own taxes, insurance, and expenses
• Are not entitled to employee benefits
• Maintain their own equipment and vehicles

12. Dispute Resolution

12.1 User Disputes

Disputes between Senders and Aerranders should first be attempted to be resolved through Aerrand's customer support. Aerrand may, but is not obligated to, assist in resolving disputes.

12.2 Arbitration Agreement

Any dispute arising from these Terms or the Platform shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, rather than in court. You waive your right to participate in class action lawsuits.

12.3 Exceptions

Small claims court actions and disputes regarding intellectual property may proceed in court rather than arbitration.

13. Intellectual Property

13.1 Aerrand Property

The Platform, including its design, features, graphics, and content, is owned by Aerrand and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without written permission.

13.2 User Content

You retain ownership of content you submit to the Platform (such as photos or messages) but grant Aerrand a worldwide, non-exclusive, royalty-free license to use, display, and distribute such content in connection with operating the Platform.

13.3 Feedback

Any feedback, suggestions, or ideas you provide to Aerrand may be used by Aerrand without compensation or obligation to you.

14. Privacy

Your use of the Platform is subject to our Privacy Policy, which explains how we collect, use, and protect your personal information. By using the Platform, you consent to our privacy practices.

15. Background Checks and Verification

15.1 Aerrander Verification

Aerrand conducts background checks on Aerranders, which may include criminal history and driving records. However, Aerrand does not guarantee the accuracy or completeness of background check information.

15.2 Verification Limitations

Background checks provide useful information but cannot guarantee safety. Users should exercise caution and good judgment when using the Platform.

16. Rating and Review System

16.1 User Ratings

Senders and Aerranders may rate and review each other after completed deliveries. Ratings and reviews must be honest and not defamatory.

16.2 Consequences

Users with consistently low ratings may have their accounts suspended or terminated.

16.3 Review Removal

Aerrand reserves the right to remove reviews that violate these Terms or are fraudulent, abusive, or discriminatory.

17. Termination

17.1 Termination by User

You may terminate your account at any time by contacting customer support or through account settings.

17.2 Termination by Aerrand

Aerrand may suspend or terminate your account immediately if you:

• Violate these Terms
• Engage in fraudulent activity
• Pose a safety risk to other users
• Receive consistently poor ratings
• Provide false information

17.3 Effect of Termination

Upon termination, you must cease all use of the Platform. Provisions that should survive termination (including liability limitations, arbitration, and intellectual property provisions) will remain in effect.

18. Changes to Terms

Aerrand reserves the right to modify these Terms at any time. Changes will be effective upon posting to the Platform. Your continued use of the Platform after changes are posted constitutes acceptance of the modified Terms. Material changes will be communicated via email or Platform notification.

19. Geographic Limitations

Aerrand services are available only in areas where we operate. We reserve the right to limit service availability in any geographic area at our discretion.

20. Force Majeure

Aerrand is not liable for delays or failures in performance resulting from circumstances beyond our reasonable control, including natural disasters, war, terrorism, labor disputes, or government actions.

21. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

22. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Aerrand regarding the Platform and supersede all prior agreements.
